Issue 16 – May 17th
Hundreds of House bills set on the various calendars died this past week as the clock for passage expired, including five bills we were tracking. There remains a significant amount of work and time to finalize bills still making progress though the process. As we dropped bills last week that were never voted out of committee, this week we have dropped all House bills that failed to meet the deadline for voting by the full House.
SB885 regarding Quit Claim Deeds has been sent to the Governor. In Texas, quitclaims negatively impact the chain of title in perpetuity. SB885 seeks to create certainty by amending the Property Code to provide a statute of limitations for quitclaims for subsequent transferees. After the fourth anniversary of the date a quitclaim deed for real property is recorded in the deed records, the deed does not affect the question of the good faith of a subsequent purchaser or creditor and does not constitute notice to a subsequent purchaser or creditor of any unrecorded conveyance, transfer, or encumbrance on the property.
